Divorce in the New Year: The Top 3 Things To Know

At Brasier Law we have noticed every year in Portland and SW Washington there are a disproportionate number of divorce filings that occur right after the holidays.  We suspect this is probably in part due to the stress of the holidays giving people that push they finally need to break out of a bad relationship, and partly due to people holding off for the sake of the kids and money until after the expectations and expenses of the holiday season are over.

There is a rush to custody and divorce filings in January

This disproportionate rush to for divorce and custody filings can cause some problems for people who want to file quickly at the beginning of January, as many attorneys receive an inrush of new clients, and the courts get a little backed up.  There are a few things you can do to help yourself prepare if you suspect you might need to start your divorce right after the holidays.

Research and call Portland Divorce Attorneys Ahead of the January Rush

First, plan ahead.  It is best, even if you aren’t quite ready to hire someone, to call around and get an idea of who you want to hire as your family law attorney.  Let them know you will likely hire them after the holidays when you are ready to proceed so that you can get moved up their priority list and also so you can get the “attorney shopping” done and are ready to make a final decision as soon as you are ready to go ahead with any divorce plans. Of course most attorneys will be happy to help you even if this is a busy time of year, but it will help you to have the ground work laid so fitting into any existing scheduling will be easier for you.

For Immediate Need or Imminent Threat Situations Don’t Wait

Second, if you are going to need any sort of immediate court intervention, like obtaining temporary financial assistance, or getting an immediate court order for placement of the children, you may want to hire the family law attorney you have chosen before Christmas.  The paperwork stage takes a short while for the attorney to get everything drafted correctly and accurately, so if you are going to need quick results, you should make that possible for your attorney to get for you by hiring them early, rather then holding off on the filing until after the New Year. If you don’t feel like you have any immediate rush to your proceedings this of course is less of a concern for you.

Finally, set your expectations appropriately.  Just know going in that the beginning of the year is often a busy time for the family courts. Just like a line at a toy store in December you will have a slightly higher chance of having someone ahead of you in the courts during January. Meaning you may suffer a few short delays that you wouldn’t deal with if you filed at a less chaotic time of year, however this is something we have experienced year after year and we doubt many would know the difference other than us and we are happy to deal with this for you.
