Financial Planning During and After Divorce

Understanding your finances

In many marriages, one spouse handled the majority of the financial planning and the direction of money and assets. After a divorce, the other spouse may feel behind a learning curve when it comes to handling finances.

At Brasier Law we are here to help. We will help to provide direction with how to proceed financially after the divorce. There are many components and details to be considered, and we will help to create a blueprint for providing for yourself and your children now, as well as planning for the future.

Divorce Financial Planning Attorney

When appropriate, we will put some of the assets into appropriate wills, trusts and other directives. This will help to shield some of the funds from probate, tax and inheritance issues down the road. These are concerns that some spouses have never had to consider in the marriage. We will guide you through the estate planning component of finances, helping to ensure you are prepared for the future.

Should you anticipate a divorce coming, we will assist you in understanding what steps you can take immediately to protect yourself. Asset division is still 50-50, but you have options in how to proceed before fiduciary duty sets in. This will allow you to position yourself as best as possible for property division proceedings.

Prenuptial and Postnuptial Agreements

We are prepared to help you create premarital agreements, such as prenups, that will protect your interests and assets should the marriage come to an end. It is important that you take time to consider this option, no matter how strong you feel the relationship is. It is always wise to have a contingency plan for the future. We will also assist with postnuptial agreements that can help protect assets after divorce.

We will guide you, fully explaining your rights and limitations in these matters. Often, most vulnerable are primary breadwinners and those entering the union with significant assets. We will help you make wise decisions for your future, providing you all of the answers and information.
